Teammate Applicant Privacy Disclosure and Authorization

1. Introduction.

Onin Staffing, LLC and its subsidiaries and affiliates (collectively, “Onin Group,” “Onin,” “we,” “our,” or “us”) is committed to protecting the personal information of individuals who apply for employment with us or who are employed by us as temporary associates (“Teammates”). This Privacy Disclosure and Authorization (“Disclosure”) explains what personal information we collect, why we collect it, how we use it, who we share it with, and how long we retain it.

This Disclosure applies to personal information collected through our Teammates App, our Uno platform, in-branch interactions, and any other means through which we collect information during the application, onboarding, and employment process. By submitting your application or continuing through the onboarding process, you acknowledge that you’ve received and reviewed this Disclosure.

You must be at least 16 years old to create a Teammates App account and use our services.

2. Information We Collect and How We Collect It.

We collect personal information from applicants and Teammates through several channels, including: (a) directly from you through the Teammates App, in-branch forms, and other documents you submit during the application and onboarding process; (b) from third-party service providers, such as background check vendors and drug screening facilities, that return results to us in connection with pre-employment screening; (c) from our banking partner in connection with direct deposit verification; and (d) automatically through the Teammates App and our other technology platforms, as described in Section 2(h) below.

The following categories describe the types of personal information we collect. Not all categories will apply to every individual; the specific information collected depends on the position, work assignment, and applicable legal requirements.

2(a). Identifying Information.

This includes your full legal name, date of birth, mailing address, email address, phone number, username, and authentication credentials. We collect your date of birth to confirm that you meet the minimum age requirement for our services and for use in legal documentation during the onboarding process.

2(b). Government Identifiers.

This includes your Social Security number, driver’s license or state identification number, and, where applicable, passport or other immigration documentation. We collect this information to verify your identity, confirm your eligibility for employment, administer payroll and tax withholding, and complete required federal and state forms (including Form I-9 and E-Verify submissions).

2(c). Employment and Background Information.

This includes your resume, work history, professional references, educational background, and the results of pre-employment background checks and drug screenings conducted by our authorized third-party vendors. Background checks and drug screenings are conducted only after appropriate authorization and disclosure under the Fair Credit Reporting Act (FCRA) and applicable state law. The FCRA requires a separate standalone disclosure and authorization before we obtain a consumer report or investigative consumer report about you; this Disclosure doesn’t replace or satisfy that separate FCRA requirement.

2(d). Financial Information.

This includes bank account and routing numbers that you provide for direct deposit enrollment, as well as tax withholding elections (Form W-4). Banking information is verified through our banking partner and is used solely for the purpose of processing payroll and administering direct deposit.

2(e). Demographic, Protected Classification, and Self-Identification Information.

We collect gender for Equal Employment Opportunity (EEO) reporting purposes. Providing your gender is voluntary; you may select “Rather not say” to opt out. We don’t provide your gender to our recruiters, and we comply with EEOC guidelines. We may also use your gender if you choose to enroll in our medical benefits. Where required or permitted by law, we may also collect voluntary self-identification information related to race, disability status, and veteran status. This information is collected for compliance with federal reporting obligations, including EEO-1 reporting requirements, under Section 503 of the Rehabilitation Act and the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA). Providing this information is voluntary and won’t affect your application or employment.

Your answers to demographic questions (race, gender, age, etc.) are kept separate from the rest of your application, and we prohibit discrimination and harassment of any kind based on race, color, sex, religion, sexual orientation, national origin, disability, genetic information, pregnancy, or any other protected characteristic as outlined by federal, state, or local laws.

2(f). Tax and Payroll Records.

This includes Forms W-2, W-4, state tax withholding forms, garnishment and income withholding orders (including medical support notices), and related payroll records generated during your employment.

2(g). Onboarding and Assignment Records.

This includes records related to your work assignments, timesheets, employment notices, client onboarding documents, and other records generated in connection with your placement at a client worksite.

2(h). Device, Location, and Usage Information.

When you use the Teammates App or access our systems electronically, we may automatically collect certain technical information, including your IP address, device type, operating system, browser type, the pages you visit within the app, the date and time of your visit, time spent on those pages, and other usage statistics. We also log authentication events and actions you take within the app (such as form submissions and document acknowledgments) for security and recordkeeping purposes.

We may collect location information from your mobile device to help you find nearby branches. For Teammates using time clock functionality, we may also collect device location to verify work location in connection with timekeeping. Location data is collected only when you grant device-level permission through your mobile operating system, and you can disable location access at any time through your device settings.

The Teammates App uses cookies and similar technologies to collect information and improve your experience. Cookies are small data files stored on your device by your browser. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent; however, if you don’t accept cookies, some features of the app may not function properly.

3. How We Use Your Information.

We use the personal information we collect for the following purposes:

  1. To evaluate your application for employment, including reviewing your qualifications, conducting reference checks, and making hiring decisions.
  2. To complete onboarding and pre-employment requirements, including identity verification, age verification, Form I-9 and E-Verify processing, background checks, and drug screenings.
  3. To administer payroll, tax withholding, and direct deposit, to provide you with access to your pay stubs and W-2s, and to comply with applicable federal and state tax reporting obligations.
  4. To manage work assignments, communicate with you regarding your employment, send you messages and updates, and maintain personnel records.
  5. To comply with legal obligations, including federal and state employment, labor, tax, workers’ compensation, workplace safety, and EEO reporting laws.
  6. To respond to lawful requests from government agencies, regulatory bodies, or as required by court order.
  7. To maintain the security and integrity of our technology platforms, including verifying user identity, detecting unauthorized access, and maintaining audit logs of system activity.
  8. To help you find nearby branch locations and, for teammates using time clock functionality, to verify your work location in connection with timekeeping.
  9. To improve our internal systems and processes, including the use of de-identified or aggregated applicant data to enhance the accuracy and efficiency of our recruiting and onboarding technology. When we use applicant data for system improvement purposes, we remove or redact personal identifiers so that the data can’t reasonably be used to identify any individual.

4. Who We Share Your Information With.

We don’t sell your personal information. We share personal information only as described below and only to the extent necessary to fulfill the stated purpose.

  1. Client Companies. When you’re placed on a work assignment, we share limited information with the client company as necessary for your placement, including your name, contact information, position, and start date. We don’t share your Social Security number, banking information, or tax records with clients.
  2. Service Providers. We share information with third-party vendors who perform services on our behalf, including background check providers, drug screening facilities, banking and payroll processors, and onboarding technology platforms. These vendors are contractually required to use your information only for the specific services they provide to us.
  3. Government Agencies. We disclose information to government agencies as required by law, including for tax reporting (IRS, state tax authorities), employment eligibility verification (USCIS/E-Verify), workers’ compensation administration, EEO reporting, and compliance with court orders or income withholding notices.

5. How Long We Keep Your Information.

We retain your personal information for as long as reasonably necessary to fulfill the purposes described in this Disclosure, and as required by applicable law. Certain categories of records are subject to minimum legal retention periods. For example:

  1. Form I-9 records must be retained for at least three years from the date of hire or one year after the date employment ends, whichever is later, as required by federal law.
  2. Tax and payroll records must be retained in accordance with IRS and applicable state tax authority requirements.
  3. Background check and drug screening records are retained for the duration of your employment and for a period thereafter as required by applicable state law.

6. How We Protect Your Information.

We maintain administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, or disclosure. Access to sensitive personal information, including financial records, medical information, and self-identification data, is restricted to personnel who have a legitimate business need for access. Certain categories of information, including disability and veteran self-identification forms, drug screening results, and medical support notices, are maintained with additional access restrictions consistent with applicable legal requirements.

In the event your personal information is involved in a security incident, we’ll provide notification as required by applicable law.

7. Updates to This Disclosure.

We may update this Disclosure from time to time to reflect changes in our practices or applicable law. The current version of this Disclosure will be available through the Teammates App.

9. Acknowledgment and Authorization.

By electronically acknowledging this Disclosure through the Teammates App, I confirm that:

  1. I have received and reviewed this Applicant and Employee Privacy Disclosure and Authorization.
  2. I understand the categories of personal information that Onin collects, the purposes for which it’s collected, and who it may be shared with as described above.
  3. I authorize Onin to collect, use, and share my personal information as described in this Disclosure for the purposes of evaluating my application, administering my employment, and complying with applicable legal requirements.
  4. I understand that providing the personal information described in this Disclosure is a condition of the application and employment process, and that failure to provide required information may result in Onin being unable to process my application or administer my employment.
  5. I understand that I may contact Onin using the contact information above if I have questions about how my personal information is handled.
